Terms of Service

These Terms of Service ("Terms") govern your use of casmatree.com (the "Site") and any services provided by Casma Tree ("Casma," "we," "us," or "our"). By using the Site, booking a service, or subscribing to Casma Shield, you agree to these Terms.

1. Services

Casma Tree provides tree care services in Polk County, Florida, including tree removal, trimming, stump grinding, gutter cleaning, land clearing, and 24/7 storm response. Service availability, pricing, and scheduling are subject to confirmation.

2. Casma Shield Membership — Recurring Billing

Casma Shield is a monthly subscription. By subscribing, you authorize Casma Tree (through our payment processor, Stripe) to automatically charge your payment method the then-current monthly fee plus applicable taxes each month until you cancel. Pricing tiers (Bronze, Silver, Gold) and included benefits are described on the Site and may change with notice.

Cancellation

You may cancel at any time from the Manage Subscription page or by contacting us. Cancellation stops future renewals. Except where required by law, fees already charged are non-refundable and benefits remain available through the end of the current billing period.

Failed Payments

If a payment fails, we may suspend or terminate benefits until payment is received. Repeated failures may result in cancellation of the subscription.

Price Changes

We may change subscription pricing on at least 30 days' notice via email or the Site. Continued membership after the effective date constitutes acceptance of the new price.

3. One-Time Services & Estimates

Estimates are valid for 30 days unless stated otherwise. Final invoices may vary based on site conditions discovered during work. Payment is due upon completion unless otherwise agreed in writing.

4. Property Access & Customer Responsibilities

• You represent that you own the property or are authorized to request work on it.
• You are responsible for marking private utilities, sprinklers, septic lines, and irrigation.
• You agree to provide safe access to the work area on the scheduled date.

5. Limitation of Liability

To the maximum extent permitted by law, Casma Tree, its owners, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid Casma in the twelve (12) months preceding the event giving rise to the claim. The Site and content are provided "as is" without warranties of any kind, express or implied, to the fullest extent allowed by law. Nothing in these Terms limits liability that cannot be limited under applicable law.

6. Indemnification

You agree to indemnify and hold Casma Tree harmless from any claims, losses, or expenses arising from your breach of these Terms or your misuse of the Services.

7. Intellectual Property

All content on the Site (logos, text, photos, the "Casma Shield" brand) is owned by or licensed to Casma Tree and protected by U.S. and international IP laws. You may not copy, reproduce, or use it without our prior written consent.

8. Communications Consent

By providing your email or phone number, you consent to receive transactional and service messages from Casma Tree. See our Privacy Policy for details and opt-out instructions.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. The exclusive venue for any dispute is the state or federal courts located in Polk County, Florida, and you consent to personal jurisdiction there. You and Casma each waive any right to a jury trial. Claims must be brought in an individual capacity and not as part of a class action.

10. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent version. Continued use of the Site or Services after changes are posted constitutes acceptance of the new Terms.
